Dehradun: The uncertainty surrounding the annual transfer of teachers in Uttarakhand has now been resolved. Following an interim order of the High Court, the government has directed the Education Department to proceed with the transfer process. The government has clarified that the court has not imposed any stay in the matter, and therefore there is no legal impediment to issuing transfer orders as per the scheduled programme.
In a letter dated August 27 sent by Education Secretary Jyoti Yadav to the Director General of School Education, the department has been directed to take action in accordance with the rules on applications received under Section 17(1)(b) of the Uttarakhand Annual Transfer Act, 2017 for Government Servants. This also includes applications submitted for transfers on request.
The uncertainty arose after the High Court’s interim order dated August 24 in Public Interest Litigation No. 106/2026, Jeevan Singh vs. State of Uttarakhand and Others. The Education Department had sought clarification from the government on whether the transfer process should be continued.
The government has now clarified that the High Court has not passed any stay order. Therefore, the transfer process can be completed within the prescribed time limit in accordance with the provisions of the Act.
The decision will provide relief to teachers who have applied under the annual transfer process. It is noteworthy that transfers in the Education Department have not taken place for a long time, and transfers on request had also not been carried out for nearly a year.
However, the hearing on the original public interest litigation will continue in the High Court, and any subsequent order by the court could affect the transfer process. For now, following the government’s directions, the way has been cleared for the annual transfer of teachers to move forward.
